The New South Wales Government has just released its 2024/2028 State Migration Plan, introducing new directions for skilled migration and announcing a nomination framework for the Federal Government’s National Innovation Visa (NIV).
What This Means For You
The State Migration Plan is focused on long term workforce development and addresses persistent skills shortages through migration. Six critical skill areas have been prioritised:
- Construction
- Net zero and energy transition
- Care and support economy
- Digital and cyber
- Agriculture and agrifood
- Advanced manufacturing
The plan also reinforces support for regional NSW and promotes systemic reform to better integrate migration with education, training, and settlement support.
Introducing the National Innovation Visa (NIV) – NSW Nomination
The NIV is a permanent, invitation only visa (subclass 858) for individuals with “exceptional and outstanding achievement”. While it is not a state sponsored visa, NSW can nominate select candidates who align with its strategic objectives. Nominees benefit from prioritised processing by the Department of Home Affairs.
NSW works within a structured nomination framework to identify and support individuals whose work significantly contributes to the state’s innovation and research landscape. This nomination pathway reflects NSW’s commitment to attracting world class talent and strengthening its position as a global centre for innovation.
NSW will nominate candidates across five distinct pathways, each tailored to a specific domain of talent outlined in Ministerial Direction No. 112:
- Academic and Researcher – For individuals conducting original research aligned with NSW’s strategic priorities. This includes published research, patents, or significant project outcomes.
- Entrepreneur – For founders or business leaders of high growth, scalable businesses with proven results.
- Innovative Investor – For experienced investors with a proven record of supporting and growing high potential businesses. Applicants must show substantial angel investment and meaningful involvement in the ventures’ growth.
- Sports Professional – For elite athletes, coaches, and specialists with national or international success.
- Creative Professional – For artists, performers, filmmakers, designers and cultural leaders with notable creative impact.
To be eligible, candidates must present a compelling track record of achievement and a credible plan to deliver impact in NSW.
NSW Nomination Process (Simplified Overview)
- Submit an Expression of Interest (EOI) – Applicants must first submit an EOI through NSW’s online portal, describing their field, achievements, and proposed contribution to NSW.
- Expert Review – EOIs will be assessed based on merit, relevance, and alignment with NSW priorities.
- Invitation to Apply – Selected candidates are invited to submit a full application, including documentation.
- Independent Endorsement – NSW will obtain third party validation of each candidate’s achievements from reputable figures or institutions with standing in the applicant’s field.
- Final Nomination – If approved, NSW will submit a Form 1000 and a formal letter of support to the Department of Home Affairs, recommending the applicant for the NIV.
Individuals nominated by the NSW Government will be considered Priority Two under the National Innovation Visa program, meaning their applications will be prioritised by the Department of Home Affairs above most other candidates, reflecting the strength and credibility of a state-endorsed nomination.

NSW gives priority to candidates who can clearly demonstrate:
- Established and verifiable achievements, rather than unproven potential
- Strong alignment with the state’s economic and innovation goals
- Tangible and ongoing impact within their area of expertise

- Applicants must demonstrate clear impact, strong endorsements, and concrete plans for contributing to NSW.
- There is no specific salary threshold for nomination, though applicants should still be prepared to meet broader visa criteria.
